Advertising Terms and Conditions

Please review our advertising terms carefully before placing an order with Local Sounds Radio.

These Advertising Terms and Conditions ("Terms") govern your use of advertising and promotional services offered by Local Sounds Radio, operated by Local Sounds ("we", "us", or "our"), an Australian digital radio and music discovery platform. By placing an advertising or promotional order with Local Sounds, you ("Client" or "you") agree to be bound by these Terms. These Terms apply to all advertising formats we offer, including on-air radio spots, digital display advertising, sponsored editorial content, artist promotional campaigns, and event listings.

1. Definitions

Agency

A media or advertising agency acting on behalf of the Client for the purpose of placing advertising orders or managing payment.

Booking

A confirmed request by the Client to broadcast, publish, or promote advertising or sponsored content on the Local Sounds platform, including on-air, digital, social, or editorial channels.

Broadcast Agreement

The agreement between you and Local Sounds outlining the specific services to be delivered, incorporating these Terms.

Client

The individual, artist, band, business, or organisation for whom advertising or promotional services are provided, including any Agency acting on their behalf.

Services

All advertising, promotion, production, and sponsorship services offered by Local Sounds, including but not limited to on-air radio advertisements, digital banner placements, sponsored editorial articles, Amplified artist campaigns, social media spotlights, newsletter inclusions, and event promotions.

Advertising Content

Any audio, visual, written, or multimedia material provided by the Client for broadcast, publication, or promotion through Local Sounds' channels.

Business Day

Any day that is not a Saturday, Sunday, or public holiday in Queensland, Australia.

2. Placing an Order

  • All advertising orders must be submitted through our online booking system, in writing via email, or through an authorised Agency.
  • Orders must clearly specify the type of advertising, desired run dates, target audience or format, and any creative or production requirements.
  • A Booking is not confirmed until you receive written confirmation from Local Sounds and full payment (or an agreed deposit) has been received.
  • Local Sounds reserves the right to reject or decline any advertising order at its sole discretion, without being required to provide a reason.
  • Where an Agency places an order on behalf of a Client, both the Agency and the Client are jointly and severally liable for payment of all fees.

3. Advertising Content Standards

  • The Client is solely responsible for the accuracy, legality, and appropriateness of all Advertising Content submitted.
  • All Advertising Content must comply with applicable Australian laws and regulations, including the Australian Consumer Law, the Broadcasting Services Act 1992, the Spam Act 2003, and any relevant ACMA guidelines.
  • Advertising Content must not be misleading, deceptive, defamatory, offensive, discriminatory, or in breach of any third-party intellectual property rights.
  • Content promoting illegal products or services, tobacco, unlicensed gambling, or adult-only material will not be accepted.
  • Local Sounds Radio reserves the right to decline, edit, suspend, or cancel any Advertising Content that it deems inconsistent with the Local Sounds brand, community values, or editorial standards — at any time and without prior notice.
  • The Client warrants that they own or have obtained all necessary licences, rights, and clearances (including music rights and talent releases) for all Advertising Content submitted to Local Sounds.
  • Local Sounds will not be liable for any claims arising from the Client's failure to obtain necessary rights or clearances for their Advertising Content.

4. Production and Creative Services

  • Local Sounds offers in-house audio production services for radio advertisements. Production fees are separate from airtime costs and will be quoted upon request.
  • Where Local Sounds produces Advertising Content on behalf of the Client, final approval must be provided in writing prior to broadcast. Unlimited revisions are not included — reasonable amendments within the agreed scope are covered.
  • All creative assets produced by Local Sounds on behalf of a Client remain the intellectual property of Local Sounds until all fees are paid in full, at which point ownership transfers to the Client.
  • Client-supplied audio files must meet our technical specifications (minimum 44.1kHz WAV or high-quality MP3 at 320kbps). Local Sounds is not responsible for broadcast quality issues arising from substandard files provided by the Client.

5. Payment

  • All advertising fees are quoted and payable in Australian Dollars (AUD) inclusive of GST where applicable.
  • Payment is required in full prior to the commencement of any advertising campaign, unless a credit arrangement has been approved in advance by Local Sounds.
  • Accepted payment methods include credit card (via Stripe) and bank transfer. Details will be provided on your invoice.
  • Invoices are due within 7 days of issue unless otherwise agreed in writing.
  • Overdue payments will incur a late fee of 1.5% per month on the outstanding balance, compounding monthly.
  • Local Sounds reserves the right to suspend or cancel a campaign if payment is not received by the due date.
  • All prices are subject to change. Confirmed bookings with full payment received will not be affected by price changes.

6. Scheduling and Delivery

  • Local Sounds will make commercially reasonable efforts to schedule and deliver advertising in accordance with the confirmed Booking.
  • While we endeavour to broadcast advertisements at specified times, exact scheduling on our 24/7 digital radio network is subject to our programming requirements and cannot be guaranteed.
  • Local Sounds reserves the right to adjust scheduling due to breaking news, emergency broadcasts, technical issues, or other unforeseen circumstances. In such cases, make-good opportunities will be provided where practical.
  • All Advertising Content must be delivered to Local Sounds at least 5 Business Days before the scheduled start date. Late delivery may result in delayed campaign commencement without entitlement to a refund.

7. Cancellation and Refunds

  • Cancellations must be submitted in writing to contact@localsounds.com.au.
  • Cancellations received more than 10 Business Days before the campaign start date will receive a full refund less a 10% administration fee.
  • Cancellations received between 5 and 10 Business Days before the campaign start date will incur a cancellation fee of 50% of the total booking value.
  • Cancellations received with fewer than 5 Business Days notice are non-refundable.
  • Campaigns that have already commenced cannot be cancelled for a refund of the remaining unused portion, unless Local Sounds has materially failed to deliver the agreed services.
  • Amplified artist campaigns that have begun the editorial or outreach phase are non-refundable once that phase has been initiated.

8. Intellectual Property

  • By submitting Advertising Content to Local Sounds, you grant us a non-exclusive, royalty-free licence to broadcast, publish, and promote that content across our channels for the duration of the agreed campaign.
  • You retain ownership of your submitted content. We will not use your Advertising Content beyond the agreed campaign without your written consent.
  • Local Sounds' name, logo, branding, and platform content are protected by copyright and trademark. You may not use Local Sounds branding for advertising or endorsement purposes without our prior written consent.

9. Disclaimer of Warranties

  • Local Sounds does not guarantee any specific outcome, reach, impressions, or commercial result from any advertising campaign.
  • Listener numbers, web traffic, and engagement metrics provided are estimates based on available data and are not guarantees of performance.
  • Local Sounds is not responsible for any indirect or consequential loss resulting from your use of our advertising services.

10. Limitation of Liability

  • To the maximum extent permitted by Australian Consumer Law, Local Sounds' total liability to the Client under or in connection with these Terms will not exceed the total fees paid by the Client for the relevant campaign in the preceding 3 months.
  • Local Sounds is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of revenue, or loss of business opportunity arising out of or in connection with your use of our advertising services.
  • Nothing in these Terms is intended to exclude any guarantees, rights, or remedies that cannot be excluded under Australian Consumer Law.

11. Term and Termination

  • These Terms apply from the date of your Booking and continue until all Services have been delivered or the Booking is cancelled.
  • Local Sounds may terminate a Booking or suspend Services immediately if the Client breaches these Terms, including failure to pay, submission of non-compliant content, or any conduct that could damage Local Sounds' reputation.
  • Termination for Client breach does not entitle the Client to any refund of fees paid.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Queensland, Australia. Both parties submit to the exclusive jurisdiction of the courts of Queensland for the resolution of any disputes arising under or in connection with these Terms.

13. Entire Agreement

These Terms, together with any Broadcast Agreement or confirmed Booking, constitute the entire agreement between you and Local Sounds regarding advertising services. They supersede all prior negotiations, representations, or agreements relating to the same subject matter.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision will be severed and the remaining provisions will continue in full force and effect.

15. Amendment

  • Local Sounds reserves the right to amend these Terms at any time by posting the updated version on our website at localsounds.com.au/advertising-terms.
  • Amendments will not apply to Bookings confirmed prior to the date of change.
  • Continued use of our advertising services after amendments are posted constitutes your acceptance of the updated Terms.
